Assessing Claims for Damages by Ports and Terminals Operators Ltd.

CARES Group was commissioned to evaluate the claim that the vessel ‘Asian Glory’ had damaged a section of reinforced concrete cope beam whilst shifting along the berth.
‘Asian Glory’ is alleged to have damaged a section of reinforced concrete cope beam on Berth 3 at Port Harcourt, whilst shifting 20m along the berth.
As a result of this, a claim for damages had been made by Ports and Terminals Operators Limited for substantial sums for:
a) Damage Repair
b) Examination / Documentation Fee
c) Handling Charges
d) Loss of Earnings
CARES Group evaluated the claims through conducting a site inspection; and, provided descriptions and measurements of the damage and repair.
CARES Group provided indicative berthing positions of the vessel and potential positions of the alleged damage to the cope beam; and, evaluated the most likely damage-causing scenario.
